Free Section 75 claim letter template

Use this letter when a qualifying credit-card purchase with a cash price over £100 and no more than £30,000 involved a breach of contract or misrepresentation. It asks the card provider to investigate its joint liability and issue the remedy due.

Who this letter is for

Make a formal Section 75 claim to your UK credit card provider. It is written in the formal register companies, landlords and card issuers expect, and it records the facts, the remedy sought and the deadline in a way that supports any later escalation to an ombudsman or the courts.

How to use this template

  1. 1Check that the total cash price was over £100 and no more than £30,000.
  2. 2Record the supplier, purchase date, total cash price and amount paid by credit card.
  3. 3Explain the breach of contract or misrepresentation and the remedy you require.
  4. 4Attach the card statement, contract or advert, supplier correspondence and evidence of loss.
  5. 5Ask for a final response and consider the Financial Ombudsman Service if the claim is rejected.

What to include before you send it

  • State the total cash price, even if only a deposit was paid by credit card.
  • Describe the supplier's breach or misrepresentation, not merely dissatisfaction.
  • Attach the card statement, contract or advert, supplier correspondence and evidence of the loss.

The rights you are relying on

Section 75 of the Consumer Credit Act 1974. A qualifying creditor can be jointly and severally liable with the supplier for a breach of contract or misrepresentation.

Re: Claim under section 75 Consumer Credit Act 1974 — account ending [LAST FOUR DIGITS]

Dear Sir or Madam,

I make a claim under section 75 of the Consumer Credit Act 1974 concerning my purchase from [SUPPLIER] on [PURCHASE DATE]. The total cash price was [TOTAL CASH PRICE], of which [CARD PAYMENT] was paid using my credit card account ending [LAST FOUR DIGITS].

The supplier breached the contract and/or made a misrepresentation as follows:

[Explain what was promised, what was supplied or not supplied, the relevant dates, and why this amounts to breach of contract or misrepresentation.]

I contacted the supplier on [DATES] and asked it to [REFUND / REPAIR / REPLACE / COMPLETE THE SERVICE]. The supplier [refused / did not respond / ceased trading / promised a refund which has not arrived]. Copies of that correspondence are enclosed.

I hold you jointly and severally liable for the supplier's breach or misrepresentation. I therefore require [STATE THE REMEDY AND AMOUNT], together with any directly connected loss claimed and evidenced in the enclosed schedule.

Please acknowledge this claim, provide a claim reference, and give your written decision within eight weeks. If you reject any part of it, please explain the facts and legal basis relied on and issue your final response so I can consider referral to the Financial Ombudsman Service.

Yours faithfully,

[Your full name]

Enclosures: card statement; receipt or contract; advert or description; supplier correspondence; photographs or other evidence; schedule of loss.

Frequently asked questions

Does Section 75 cover a credit-card deposit?
It can. If the total cash price is over £100 and no more than £30,000, paying only part of that price by a qualifying credit card may still engage Section 75.
Is Section 75 the same as chargeback?
No. Section 75 is a statutory claim based on creditor liability; chargeback is a card-scheme process with different conditions and time limits.
